Government plans to boost fund industry

LONDON (Reuters) - Britain has launched a campaign to attract more investment fund money to the country, with plans for tax breaks, cutting red tape and marketing campaigns in Asia and the Americas.

In speeches to fund management executives on Tuesday afternoon, Treasury ministers Sajid Javid and Greg Clark said they aim to reverse a weakening of the UK's dominance as a centre for the funds industry.

While London and Edinburgh are the locations for teams of fund managers at firms such as Schroders and Aberdeen Asset Management, more funds are domiciled in Dublin and Luxembourg.

According to Lipper, a Thomson Reuters company that tracks the funds industry, around $1.24 trillion (817.56 billion pounds) of mutual fund assets are domiciled in Dublin and $2.8 trillion in Luxembourg compared with around $1.1 trillion in the UK.

Clark said the government's strategy will focus on more efficient and transparent taxation, while new financial watchdog the FCA will seek to cut red tape around obtaining fund authorisation.

"We also promise to consult closely with industry to ensure that opportunities to minimise costs and maximise benefits are identified and implemented," Clark said.

He also said the government will seek to promote the UK as a fund management centre, running a marketing campaign targeting investors in Asia and the Americas.

The government first announced in March that it was targeting mutual fund money domiciled in Ireland and Luxembourg with tax sweeteners.

Earlier on Tuesday, Clark told delegates at an industry seminar in London the government plans a similar boost for Britain's insurance industry.

What Explains the Recent Outbreak of Tornadoes?

Tornado season has been relatively quiet this year. There were only 72 tornadoes nationwide in April, 70 percent below the 10 year average, according to the Weather Channel. But within in the last week, tornado outbreaks have been erupting from North Texas to Minnesota.

Why do these tornadoes seem to be hitting all of a sudden?

An eastward advancing cold front is to blame. This pocket of cold air has run into warm air from the Gulf of Mexico. Like a wedge, the cold front has caused the warm air to rise, since it's less dense, said Jeff Weber, a scientist with the University Corporation for Atmospheric Research in Boulder, Colo.

"It's kind of the perfect setup," Weber told LiveScience.

This rising warm air has created thunderstorms that have in turn spawned tornadoes, which draw their rotation from the system's abundant wind shear, which is a change in wind speed and direction with altitude. In this case, winds have blown north off the Gulf of Mexico, and interacted with currents moving east along with the cold front, Weber said. This follows a relatively calm spring that saw few tornadoes, which is largely due to unusually cold temperatures throughout much of the country. The cold can in turn be blamed on the fact that the jet stream, the ribbon of wind that stretches across the Northern Hemisphere, dipped farther south than usual. This brought with it frigid Arctic air and prevented warm, moist air from the Gulf of Mexico from advancing northward.

Last week, with the jet stream shifting north and the atmosphere more conducive to tornado formation, an outbreak of an estimated 16 twisters erupted in North Texas on May 15. The tornadoes ranged in strength from an EF-1 in the town of Millsap that caused damage to roofs, to an EF-4 in Granbury that completely destroyed houses.

The Texas tornadoes were worsened by the fact that the jet stream dipped south during this outbreak, adding extra rotational power to the twisters, Weber said.

In the next few days, this system should soon weaken, Weber said. That's because the center of the cold front's circulation is now over Minnesota and Wisconsin, and warm air has filled the center of the country. This means there will be less interaction between masses of cold and warm air, which fuel tornadoes' destructive power, Weber said.

(AP) ? The police officer who accidentally killed a Long Island college student along with an armed intruder faced perhaps the most harrowing decision in law enforcement: choosing the split-second moment when the risk is so high that you must pull the trigger.

That's the moment authorities say a Nassau County police officer experienced early Friday morning when a masked man holding 21-year-old Andrea Rebello in a headlock pointed a loaded handgun at him.

"The big question is, how do you know, when someone's pointing a gun at you, whether you should keep talking to them, or shoot?" said Michele Galietta, a professor of psychology at the John Jay College of Criminal Justice who helps train police officers. "That's what makes the job of an officer amazingly difficult."

She spoke Sunday as Hofstra University students honored Rebello, a popular public relations major, by wearing white ribbons at their graduation ceremony.

On Saturday evening, flags on the Hempstead campus were at half-staff and students held a silent outdoor vigil in front of a photo of the young woman. Surrounded by candles and flowers, they sang "Ave Maria."

Rebello's funeral is scheduled for Wednesday in Sleepy Hollow, in Westchester County, north of New York City.

Her life ended in the seconds that forced the veteran police officer to make a fatal decision, but the questions surrounding the student's death are just beginning, along with an internal investigation by the Nassau County Police Department.

The bare facts are simple. Rebello and the intruder, Dalton Smith, died early Friday when the officer fired eight shots, hitting him seven times, with one bullet striking Rebello once in the head, according to county homicide squad Lt. John Azzata.

With a gun pointed at her, Smith "kept saying, 'I'm going to kill her,' and then he pointed the gun at the police officer," according to Azzata.

The officer acted quickly, saying later that he believed his and Rebello's life were in danger, according to authorities.

No doubt, he was acting to try to save lives ? his own and that of the young woman, Galietta said.

"What we're asking the cop to anticipate is, 'What is going on in the suspect's mind at the moment?'" she said. "We're always trying to de-escalate, to contain a situation, but the issue of safety comes in first, and that's the evaluation the officer has to make."

Eugene O'Donnell, a former New York City police officer and professor of law and police studies at John Jay College, said the crucial issue may be whether or not police had deemed it a hostage situation. If so, he said, there are protocols police follow to buy time, slow down, isolate and assess.

But O'Donnell said the officers may have had few options because of "an eyeball to eyeball confrontation between the officer and the offender."

"It may have been too fluid to deteriorate for the officers to do anything else," O'Donnell said. "It underscores that there's no two of these that are exactly alike."

Police tactical manuals are meant to assist officers in making the best decision possible, but in the end, "they're not 100 percent foolproof," Galietta said. "In a situation like that, you can follow procedure, and it doesn't mean it comes out perfectly."

The officer who fired the shots is an eight-year NYPD veteran and has been with Nassau County police for 12 years.

He is now out on sick leave, Azzata said.

Procedurally, the Nassau County district attorney's office would determine whether an officer's use of deadly force was justified. O'Donnell said. A spokesman for the district attorney's office did not respond to a request for comment Saturday night.

There are some rules governing the use of force for New York police officers. A subsection of Article 35 of New York Penal Law prohibits against recklessly endangering innocent people.

RICHMOND, Va. (AP) ? Virginia's activist conservative attorney general has won the Republican Party's gubernatorial nomination by acclamation.

At the GOP's statewide convention, thousands of conservatives and tea party followers who dominated the Richmond Coliseum on Saturday roared their unanimous support for Ken Cuccinelli. He was unopposed for the nomination and is generally beloved by the tea party for his aggressive challenges to federal mandates

Cuccinelli is an abortion foe who was the first state attorney general to challenge President Barack Obama's health care reforms in 2010.

He faces former Democratic National Committee chairman and Clinton family protege Terry McAuliffe in the Nov. 5 election to become Virginia's 72nd governor.

At age 44, the father of seven becomes the youngest Republican nominee for Virginia governor since former Gov. George Allen 20 years ago.

'Gimme the Loot' is ... meandering and a little shallow. And even at 79 minutes it feels a little too long for what's essentially the film equivalent of a short story.

A thousand-watt jolt of mischief, a spunky, funky, ebullient indie that packs its 81 minutes with cinematic exhilaration.

It may be a slight movie, but it has its sunny charms.

A movie about teenage taggers in the Bronx should be fast and raw, scruffy and loose, and Adam Leon's Gimme the Loot is just that.

As it lopes along, the movie offers a warm but very sharp portrait of New York's have-nots and their uneasy relationship with the haves.

"Gimme the Loot" shouldn't be as appealing and exuberant as it is, it really shouldn't.

First-time feature director Adam Leon's shots are precise and full of detail.

The film's strong suit is its use of locations.

The film is episodic and determinedly offbeat, funny at its best, boring at its worst.

Shot on the streets of New York in a loose, freeform style, this lively comedy-drama feels somewhat underdeveloped, leaving us doubtful about its realism.

It's a great deal of fun, emotionally touching, and even surprisingly old-fashioned.

Some of the movie doesn't exactly convince, and some of the scenes have an actors-improv feel to them, but there's always plenty of humour and energy.

Endlessly entertaining, refreshingly light-hearted and bursting with summer soul, Gimme The Loot joins the pantheon of great New York movies.

It's a shaggy dog story with a certain amount of charm but not nearly enough drama.

The movie is unpolished, and it matters not a jot, because Leon has written super roles for these kids and invests their relationship with such sly feeling.

Hickson walks the line between bravado and vulnerability, while Washington has a charisma, spark and beauty that should ensure this won't be the last we see of her.

Bolstered by a low-key but assured aesthetic and a soundtrack of vintage soul and doo-wop, the film is infectiously enjoyable, with frequently amusing insights and an affable shagginess.

Out of nowhere, Adam Leon might just have delivered the first great New York film of the decade.

Charming and engaging low-budget indie with a witty script, likeable characters, a strong sense of time and place and a pair of terrific performances from its two young leads.

Funny and freewheeling, it's a joy.

A slim, low-budget coming-of-age tale whose richness lies entirely in its interstices. A keenly observed work that celebrates the unfettered joys of youth, and rewards by reminding of the power of a simple tale told well.

Simultaneously real and hopeful, "Loot" has almost no plot, but when the setting is so fresh and the characters feel so raw and alive, who needs one?

Ghetto laughs with a sophisticated point of view.

Two men charged with killing Malcolm X grandson

MEXICO CITY (Reuters) - Two men arrested in the fatal beating of the grandson of U.S. civil rights activist Malcolm X were sent to prison on Saturday to await trial, a Mexico City court spokesman said.

David Hernandez and Manuel Perez, waiters at the Palace nightclub near Mexico City's popular Garibaldi Square, face charges of murder and robbery, the official said.

Malcolm Shabazz, who police have said was 29, died May 9 at the Palace after a dispute over a $1,200 bill. Hernandez and Perez were arrested on Monday.

Shabazz, who was convicted of manslaughter as a 12-year-old for setting a fire that killed his grandmother and went to prison as an adult for attempted robbery, was in Mexico City to visit Miguel Suarez, an immigration activist who was recently deported from the United States. Shabazz

On the night of May 8 Shabazz and Suarez visited the run-down area around Plaza Garibaldi, a popular tourist area where Mariachi music groups play on the streets amid seedy strip clubs, dive bars and bordellos.

Despite its proximity to the city's grand colonial center, the area is infamous for petty crime.

Malcolm X was a civil rights activist and leader of the black Muslim movement in the United States. He was shot to death before a speaking appearance in New York City in 1965.

Sci-fi fans are generally fairly mild-mannered folk. But don't get them angry. You wouldn't like them when they're angry. Unfortunately, there was lots of anger in Norwich, UK, over the weekend, when fans of "Doctor Who" and "Star Wars" squared off outside a convention -- and yes, "the force" was called. The police force.

According to Norwich Evening News 24, it all started at the 4th Norwich Sci-Fi and Film Convention on Sunday, which was hosted by the Norwich "Star Wars" Club UK and Hollywood Cinemas. The convention refused entry to members of the Norwich Sci-Fi Club by the members of the Norwich "Star Wars" Club, reportedly after the treasurer of the Sci-Fi Club asked a "Doctor Who" actor for an autograph.

Sci-Fi Club treasurer Jim Poole was asked to leave after requesting the autograph, and he and organizer Richard Walker reportedly had words inside before taking it outdoors.

It's unclear why this was a flashpoint -- Walker later told Evening News 24 that the visitors had been trying to undermine the convention with Facebook comments -- but it led to over a dozen fans (many dressed in costume) facing off outside the venue.

There were no light saber and sonic screwdriver duels, but police did respond to a report that a man was being assaulted. After investigating and reviewing closed-circuit footage, police determined no assault had taken place. A spokesperson told the News that "the two rival groups were spoken to and advised to keep out of each other's way."

Despite the incident, Walker called the event "a very successful day."

At least no one had to go to the dark side.

After hosting ballroom boots for 16 seasons, the Tuesday night results show on "Dancing With the Stars" will soon be sent packing too. Starting next season, ABC will only broadcast one two-hour episode of the dance competition each week.

Host Tom Bergeron and several of the show?s veteran pro dancers shared their thoughts on the move after the most recent results show.

?I?m kind of a ?the glass is half full? type guy,? Bergeron told TODAY.com on the red carpet leading into the show?s 300th episode party. ?I get the rationale behind it. There?s no denying that our numbers have been slipping.?

The impetus behind axing the Tuesday results show is to drive those viewers to the Monday performance and get a stronger rating there.

Plus, it?ll keep producers from wracking their brains on how to fill up three hours of programming each week.

?There have been times in the past -- and this will not come as a news flash to you -- we?re stretching to fill two hours,? Bergeron noted. ?How much water can you put in the soup? This (change) will afford us the luxury of not having to worry about that. Now, (we?ll have) an embarrassment of riches in what we can do.?

?It?s obviously sad,? said pro dancer Cheryl Burke. ?We?ve been going twice a week for the past 16 seasons.

?But I think it?s going to be a great change,? the two-time mirror ball champion hastened to add. ?It?ll keep people interested in the show. You?re going to see lots of entertainment, competitors and elimination every single Monday.?

?I have two minds about it,? said Derek Hough, the competition?s only three-time champion. ?The show is going to make it work and it?ll be fantastic, but I?m going to miss doing special performances on the Tuesday shows. I will enjoy having that extra day of rehearsal on Tuesday.?

Perhaps the people most affected by this move will be members of the "Dancing With the Stars" troupe -- the farm team of dance pros that currently includes Sasha Farber and Henry Byalikov. Troupe members who?ve been bumped up to being paired with celebrities include Peta Murgatroyd and Sharna Burgess.

?I was thinking of those guys (in the troupe),? Murgatroyd said. ?It?s kind of disappointing for them, but (the show) could still have them do a number on Monday night.?

Pro dancer Tony Dovolani predicts that the format of the show will evolve as the new production model is put into place.

?As the season goes on and more people get eliminated the more time we?ll have to put some of those dances (previously seen on Tuesdays) in on Mondays,? he pointed out.

Bergeron and the dancers are in unison on one thing ? the dramatic eliminations will likely occur at the end of the show, not the beginning.

?Mark Ballas and I were talking about this,? Bergeron says. ?While I?m not the ultimate decider, as someone once famously said, I think it?d be more dramatic to have (the elimination) at the end of the show.?

Warming in central China greater than most climate models indicated

May 15, 2013 ? Temperatures in central China are 10 to 14 degrees Fahrenheit hotter today than they were 20,000 years ago, during the last ice age, UCLA researchers report -- an increase two to four times greater than many scientists previously thought.

The findings, published today in the early online edition of the journal Proceedings of the National Academy of Sciences, could help researchers develop more accurate models of past climate change and better predict such changes in the future.

"Previously, we could only infer temperature on land through changes in climate archives like tree rings or pollen over time," said lead author Robert Eagle, a UCLA researcher in the department of Earth and space sciences. "This is the first time that temperature has been determined accurately on land at the time of the last ice age."

To make their temperature measurements, the scientists used a technique known as clumped isotope thermometry, which detects subtle atomic differences in calcium carbonate, a compound commonly found in rocks, snail shells and wind-blown dust deposits known as loess. The method is the most accurate land-based temperature-determination tool available today.

"We can now tell what temperatures were on land 20,000 years ago with more accuracy than was ever previously possible," said senior author Aradhna Tripati, a UCLA assistant professor in the department of Earth and space sciences and the department of atmospheric and oceanic sciences.

Tripati and Eagle chose to study the Loess Plateau in central China, a 250,000-square-mile agricultural region some 500 miles southwest of Beijing, because of its wide expanses of loess, the silty sediments that give the area its name and which contain deposits from the last ice age.

"We can calculate temperatures and reconstruct the chemistry of rainwater from the past ice age, then compare this to the present day climate in specific regions," Eagle said. "We can then use this information to validate current climate models and study atmospheric processes."

The researchers collected two unique ice age sample types from the Loess Plateau region: fossilized land-snail shells and soil deposits. While snails calcify quickly over just a few years, soil carbonates grow over longer time periods, ranging from a few hundred to thousands of years. Eagle and Tripati used clumped isotope thermometry to determine the temperature at which these samples formed roughly 20,000 years ago.

"One of the most important aspects of the study was showing that we could get the same result from such different types of carbonates," said Tripati, who is also a member of UCLA's Institute of the Environment and Sustainability. "Even though these materials integrate over very different time frames, they gave us the same result."

Comparing the findings with climate models

When Eagle and Tripati matched their findings against climate models predicting the change in temperature in central China from the previous ice age to the present, they found that those models that took into account atmospheric processes tended to be more accurate.

"The climate models that did the best job of resolving temperature changes in this region were the ones that accurately depicted very large-scale atmospheric processes, such as patterns of winds in the atmosphere, the position of the jet stream and various atmospheric fronts," Tripati said. "The models that didn't resolve these atmospheric phenomena tended to do a poorer job of predicting temperature.

"It's so important to have models that accurately depict regional climates on land for the study of past and future climate change. We were surprised at how poorly most climate models predicted temperature change in central China and also surprised at how sensitive this region has been to changes in climate forcing."

Since the last ice age, numerous factors have influenced changes in global wind and precipitation patterns in Earth's atmosphere. Atmospheric processes move in relation to a standing, stationary wave, which is an oscillating reference point that wraps around our planet like an invisible piece of string. The position of that wave around our planet has changed over time. Contributing factors have been a rise in carbon dioxide and other greenhouse gases, changes in incoming solar radiation and changes in the amount of ice covering Earth's surface.

For example, ice sheets can deflect the stationary waves so that winds and precipitation patterns fall more frequently in certain locations on the planet. But as ice has melted over the last 20,000 years, the stationary waves have shifted, influencing the circulation of the atmosphere.

"Clumped isotope thermometry has allowed us to say with more confidence how temperatures have warmed in central China, and how the chemistry of rainfall has changed. The climate models that did the best job of simulating temperature changes seemed to also be the ones to give the best depiction of changes in water cycling in this region," Tripati said. "Our results suggest that in this region, temperature, water cycling and winds are very sensitive to changing climate forcing. Rises in greenhouse gas levels, melting ice sheets and changes in solar radiation can all affect not only temperature but precipitation and winds as well."

"We have not dissected out the specific role of greenhouse gases, such as carbon dioxide, in this study, but they are certainly a contributing factor to temperature change and ice-sheet extent," Eagle said.

The climate model developed by researchers at France's Institut Pierre Simon Laplace des sciences de l'Environnement Global (the IPSL model) closely matched the data for this region in this study, but it has traditionally been one of the less frequently used climate models for predicting future climate change.

"That is quite extraordinary," said Eagle, "because while more commonly used models have simulated a very small amount of temperature change in the region, that prediction was not validated by our data."

Types of sediment similar to that found in central China exist in the Midwestern U.S., ranging from Mississippi to Nebraska, and they are currently being studied by scientists at UCLA.

"One of the things we're doing is measuring samples from the loess deposits in the Midwestern U.S. to see how climate has changed in these regions," Tripati said. "These deposits were also formed at the time of the last ice age and contain similar types of snail and soil carbonates that we analyzed in central China. It will be interesting to repeat a similar investigation in this region."

U.S. widens sanctions to four Syrian officials, TV station, airline

WASHINGTON (Reuters) - The U.S. government on Thursday blacklisted four Syrian government ministers, an airline and a television station it said helped the Assad government in its two-year crackdown on opposition forces.

The move follows broad U.S. sanctions on any aid to Syria since the beginning of the civil war between President Bashar al-Assad's government and opposition groups that has killed an estimated 80,000 people.

The U.S. Treasury Department said the government-owned airline, Syrian Arab Airlines, helped Iran's Islamic Revolutionary Guards ship illegal cargo - including rockets, anti-aircraft guns and ammunition - to aid the Syrian government.

The United States also accused the privately held Al-Dunya Television of assisting Assad's propaganda by airing forced confessions. Al-Dunya also helped the government disseminate fake weapons busts and arrest people it had interviewed, according to Treasury.

Treasury also blacklisted, or designated, four Syrian officials: the ministers of defense, health, industry, and justice, as part of its broader steps to stymie the government's activities. The defense minister, Fahed Jaseem al-Freij, has been in charge of Syria's armed forces during air strikes and executions of civilians, according to the U.S. government.

"Treasury will continue to use all of the tools at our disposal to expose and disrupt the financial networks of those responsible for the Syrian government's egregious campaign to suppress its people," Treasury Undersecretary for Terrorism and Financial Intelligence David Cohen said in a statement.

U.S. President Barack Obama on Thursday said he may use a range of diplomatic and military options against Assad's government if he gets conclusive proof it used chemical weapons in the country's civil war.

The new sanctions forbid U.S. citizens from any financial dealing with the officials and companies, and also freeze their assets within the United States. Although the officials are unlikely to hold money in U.S. banks, many foreign banks are also reluctant to deal with companies and people that have been blacklisted by the United States.

In 2011, the United States froze all Syrian assets in the United States and barred U.S. citizens from making new investments or exporting services to Syria. It has also imposed sanctions on Syria's government, central bank, oil companies and more than 100 other individuals.

New global study pinpoints main causes of childhood diarrheal diseases, suggests effective solutions

BALTIMORE, May 13, 2013 ? A new international study published today in The Lancet provides the clearest picture yet of the impact and most common causes of diarrheal diseases, the second leading killer of young children globally, after pneumonia. The Global Enteric Multicenter Study (GEMS) is the largest study ever conducted on diarrheal diseases in developing countries, enrolling more than 20,000 children from seven sites across Asia and Africa.

GEMS, coordinated by the University of Maryland School of Medicine's Center for Vaccine Development, confirmed rotavirus ? for which a vaccine already exists ? as the leading cause of diarrheal diseases among infants and identified other top causes for which additional research is urgently needed. GEMS found that approximately one in five children under the age of two suffer from moderate-to-severe diarrhea (MSD) each year, which increased children's risk of death 8.5-fold and led to stunted growth over a two-month follow-up period.

"Until now, comprehensive data on the burden of diarrheal diseases in Asia and sub-Saharan Africa has been limited," said Dr. Myron M. Levine, GEMS Principal Investigator and Professor at the University of Maryland School of Medicine. "By filling critical gaps in knowledge, we hope GEMS will help countries across these two highest-burden regions focus their efforts to improve child health."

Despite many causes, GEMS found that targeting just four pathogens could prevent the majority of MSD cases. Expanding access to vaccines for rotavirus, the leading cause of MSD among infants at every site, could save hundreds of thousands of lives. Likewise, GEMS data suggests that accelerating research on vaccines, treatments and diagnostics for the three other leading pathogens ? Shigella, Cryptosporidium and ST-ETEC, a type of E. coli ? could have a similar impact. Prior to GEMS, Cryptosporidium was not considered a major cause of diarrheal disease and as a result there is currently little research on this pathogen underway.

"The GEMS findings help set priorities for investments that could greatly reduce the burden of childhood diarrheal diseases," said Dr. Thomas Brewer, deputy director of the Enteric & Diarrheal Diseases team at the Bill & Melinda Gates Foundation, which funded the study. "Vaccines and treatments available today can save thousands of children right now but targeted research to develop new tools to combat severe diarrhea could save many more lives in the future."

The GEMS findings also suggest that longer-term monitoring and care of children with diarrheal diseases could reduce mortality and developmental delays. Children with MSD grew significantly less in height in the two months following the diarrheal episode when compared with control children without diarrhea, and were 8.5 times more likely to die over the course of the two-month follow-up period. Notably, 61 percent of deaths occurred more than a week after the initial diarrheal episode, with 56 percent of deaths happening after families had returned home from a healthcare facility.

"GEMS strongly indicates that follow-up care after the initial diarrheal episode is critical to protect the health and wellbeing of children," said Professor George Griffin, Senior Co-Chair of the GEMS International Strategic Advisory Committee and Professor at St. George's, University of London. "By focusing only on the acute diarrhea that brings children to hospitals, we overlook a significant portion of diarrheal diseases' burden."

Expanding access to existing interventions that protect against or treat all diarrheal diseases, including oral rehydration solutions, zinc supplements, clean water and sanitation, can save lives and improve the health of children immediately.

"GEMS is a landmark study for the child health community," said Professor Fred Binka, Co-Chair of the GEMS International Strategic Advisory Committee and Vice-Chancellor at the University of Health and Allied Sciences, Ghana. "By using consistent methods across countries, GEMS sites generated data that can guide evidence-based decision making at both the local and global levels."

Release of the GEMS findings follows last month's announcement by the World Health Organization and UNICEF of the first-ever Integrated Global Action Plan for the Prevention and Control of Pneumonia and Diarrhea (GAPPD). The GEMS findings add to the scientific evidence cited in the GAPPD strategy for effectively controlling pneumonia and diarrhea, which together are the two leading causes of death among young children globally.

What Is TPP? The Biggest Global Threat to the Internet Since ACTA

The United States and ten governments from around the Pacific are meeting yet again to hash out the secret Trans-Pacific Partnership agreement (TPP) on May 15-24 in Lima, Peru. The TPP is one of the worst global threats to the Internet since ACTA. Since the negotiations have been secretive from the beginning, we mainly know what's in the current version of this trade agreement because of a leaked draft [PDF] from February 2011. Based upon that text, some other leaked notes, and the undemocratic nature of the entire process, we have every reason to be alarmed about the copyright enforcement provisions contained in this multinational trade deal.

The TPP is likely to export some of the worst features of U.S. copyright law to Pacific Rim countries: a broad ban on breaking digital locks on devices and creative works (even for legal purposes), a minimumcopyright term of the lifetime of the creator plus seventy years (the current international norm is the lifetime plus fifty years), privatization of enforcement for copyright infringement, ruinous statutory damages with no proof of actual harm, and government seizures of computers and equipment involved in alleged infringement. Moreover, the TPP is worse than U.S. copyright rules: it does not export the many balances and exceptions that favor the public interest and act as safety valves in limiting rightsholders? protection. Adding insult to injury, the TPP's temporary copies provision will likely create chilling effects on how people and companies behave online and their basic ability to use and create on the Web.

The stated goal of the TPP is to unite the Pacific Rim countries by harmonizing tariffs and trade rules between them, but in reality, it's much more than that. The "intellectual property" chapter in this massive trade agreement will likely force changes to copyright and patent rules in each of the signatory countries. Accepting these new rules will not just re-write national laws, but will also restrict the possibility for countries to introduce more balanced copyright laws in the future. This strategy may end up harming other countries' more proportionate laws such as Chile, where a judicial order is required for ISPs to be held liable for copyright infringement and take down content. Such systems better protect users and intermediaries from disproportionate or censorship-driven takedowns. If the final TPP text forces countries to adopt a privatized notice and takedown regime, this could imply the end of the Chilean system. It would also undermine canada's notice and notice regime.

The content industry can and will continue to buy and lie to get their way to get laws that protects their interests, and what they want more than anything is for us to remain passively ignorant. They did it with SOPA, ACTA, and now it's TPP [ESP]. It's going to be a challenge to defeat these policies, but we can do it. The TPP is slated for conclusion this October, but our goal is to get the worst of these copyright provisions out of it. The way to fight back is to show that we will not put up with this: to demand an open transparent process that allows everyone, including experts from civil society members, to analyze, question, and probe any initiatives to regulate the Internet. The secrecy must be stopped once and for all.

Drug manufacturer agrees to $500 million penalty

(AP) ? A subsidiary of India's largest pharmaceutical company has agreed to pay a record $500 million in fines and penalties for selling adulterated drugs and lying to federal regulators in a case that is part of an ongoing crackdown on the quality of generic drugs flowing into the U.S.

Federal prosecutors said Monday the guilty plea by Ranbaxy USA Inc. represents the largest financial penalty against a generic drug company for violations of the Federal Food, Drug and Cosmetic Act, which prohibits the sale of impure drugs.

It concludes a years-long federal investigation into Ranbaxy's manufacturing deficiencies. The Food and Drug Administration had earlier barred from the company from importing more than 30 different drugs made at factories in India and struck a deal that required the company to ensure that data on its products is accurate and to improve its drug-making procedures.

The subsidiary of Ranbaxy Laboratories Limited admitted that it made and sold impure drugs at two manufacturing sites in India. Prosecutors said the batches of adulterated drugs, whose strength, purity or quality differed from the specifications, included generic versions of an antibiotic and other medications used to treat severe nodular acne, epilepsy and nerve pain.

It's not known whether the problems with the drugs led to any health issues. The problems were largely revealed by a whistleblower in a federal lawsuit. The federal allegations against the company make no claims that the drugs harmed anyone.

The company admitted to a wide range of deficiencies, including improperly storing drug samples waiting to be tested, continuing to sell a drug even after it had failed purity tests and waiting months to voluntarily recall medication that it knew would not maintain its expected shelf life.

Ranbaxy also admitted making false statements to the FDA in 2006 and 2007 annual reports about dates of tests. In some cases, the tests were done months after the company said they'd been performed. Or the tests were done on the same day ? or within days of each other ? instead of months apart, the prescribed interval.

The company said it fully cooperated with the investigation, which it said involved actions from several years ago, and expects "future growth in the U.S. and around the world."

"While we are disappointed by the conduct of the past that led to this investigation, we strongly believe that settling this matter now is in the best interest of all of Ranbaxy's stakeholders; the conclusion of the DOJ investigation does not materially impact our current financial situation or performance," Ranbaxy CEO Arun Sawhney said in a statement.

The company had faced scrutiny in recent years. In November, Ranbaxy halted production of generic cholesterol drug Lipitor while it investigated how tiny glass particles got into dozens of recalled batches.

The case comes as federal regulators and prosecutors focus attention on the quality of ingredients of generics and other drugs manufactured overseas, said Alan Couckell, an expert on drug safety at The Pew Charitable Trusts. He said the 2008 deaths linked to tainted heparin, a blood thinner produced in China, served as a "wake up call" about just how much of the nation's drug supply comes from overseas.

"Over the last few years, the FDA and others have been increasingly focused on the risks associated with global drug manufacturing. The agency now has new authority and new resources which should result in an increased scrutiny on the highest-risk facilities," he said.

The company agreed as part of Monday's deal to a fine and forfeiture of $150 million as well as an additional $350 million penalty to settle civil claims that it submitted false statements to Medicaid, Medicare and other government health care programs. About $49 million of that penalty will go to a former Ranbaxy executive, Dinesh Thakur, who acted as a whistleblower by filing a federal lawsuit accusing the company of knowingly submitting false information to the Food and Drug Administration, prosecutors said.

Thakur said in a statement that the company had been notified of the problems, and "when they failed to correct the problems, it left me with no choice but to alert healthcare authorities."

"He was the source, the original source, of the information to the government that ultimately led to the government's earlier actions," said Andrew Beato, one of Thakur's lawyers.
