German court upholds ban on original Galaxy Tab 10.1

While Samsung was more than willing to redesign its flagship tablet in the face of the German court's ruling last year, the higher regional court in Dusseldorf maintains that the original still can't be sold within its borders. As Samsung and Apple continue their legal fisticuffs worldwide, the claim from Cupertino that the 10.1-inch Android tablet is too similar to its own iPad has seen more attention than most. Samsung returned the favor by counter-suing over mobile technology patents, although it's been just as unfortunate here, losing two out of the three infringement claims. The final case will be ruled on in early March. Today's decision will also encompass the Galaxy Tab 8.9, although given that this ruling is based on Germany's own unfair competition law, it makes it unlikely to be replicated elsewhere. Meanwhile, the Galaxy Tab 10.1N remains on shelves -- and very desperate tablet fans just a short drive away from neighboring countries still able to sell the original.

UN nuclear officials want Iranian cooperation (AP)

VIENNA ? The head of a U.N. nuclear team traveling to Iran on Saturday urged the country to work with his mission on probing Tehran's alleged attempts to develop an atomic arms program, adding such cooperation is long overdue.

The unusually blunt comments by International Atomic Energy Deputy Director General Herman Nackaerts reflected the importance the IAEA is attaching to the chief focus of the trip ? ending more than three years of Iranian refusal to answer questions about such suspicions.

Ahead of departure, Nackaerts told reporters at Vienna airport he hopes Iran "will engage with us on all concerns."

"So we're looking forward to the start of a dialogue," he said: "A dialogue that is overdue since very long."

Diplomats said Iran had accepted the inclusion of two senior weapons experts ? Jacques Baute of France and Neville Whiting of South Africa ? with relatively little fuss. That suggests the Islamic Republic may be prepared to address some issues related to the allegations.

Also on the team is Rafael Grossi, IAEA chief Yukiya Amano's right-hand man.

Any progress would be significant.

Tehran has blocked IAEA attempts for more than three years to follow up on U.S. and other intelligence, dismissing the charges as baseless and insisting all its nuclear activities were peaceful and under IAEA purview.

Faced with Iranian stonewalling, the IAEA summarized its body of information in November, in a 13-page document drawing on 1,000 pages of intelligence. It stated then for the first time that some of the alleged experiments can have no other purpose than developing nuclear weapons.

Iran continues to deny the charges and no change in its position is expected during the three-day Tehran talks with IAEA officials. But even a decision to enter a discussion over the allegations would be a major departure from outright refusal to talk about them.

The diplomats said that the IAEA team was looking for permission to talk to key Iranian scientists suspected of weapons work, inspect documents relating to such suspected work and get commitments for future visits to sites linked to such allegations.

Iran says it is enriching only to generate energy. But it has also started producing uranium at a higher level than its main stockpile ? a move that would jump-start the creation of highly enriched, weapons-grade uranium, should it chose to go that route. And it is moving its higher-enriched operation into an underground bunker that it says is safe from attack.

Some slam Nazis; others gather for right-wing ball (AP)

VIENNA ? Austrians gathered in memory of the 2 million Jews murdered in Adolf Hitler's Auschwitz camp condemned plans to hold a ball of extreme rightists later in the day Friday, saying the event's timing transformed it into a macabre dance on Holocaust victims' graves.

Ball organizers insisted the fact that their event coincided this year with the 67th anniversary of the death camp's liberation was coincidental and denied suggestions that those attending were extremists.

But opponents vehemently criticized both the day chosen to hold the WKR ball and the political views of those attending it, suggesting it regularly attracts elements from the neo-Nazi fringe. The ball is to be held in Vienna's ornate Hofburg palace, less than a minute's walk away from the memorial event.

The dispute reflects both the distance Austria has come in acknowledging its role in Nazi atrocities and stubborn rightist sentiment among some here, who see themselves as Germans and Germans as the superior race ? a common regional building block of anti-Semitism.

Some of the most bitter comments came from the crowd that converged on Vienna's Heldenplatz, or Heroes' Square, to lay wreaths for the victims of Auschwitz, the concentration camp in occupied Poland where some of Nazis' greatest atrocities were committed during the Holocaust.

"You, who will dance and celebrate here; we remind you of the murder of two-thirds of Europe's Jews," proclaimed Holocaust survivor Rudolf Gelbard. Insisting that Nazi atrocities must never be forgotten, Greens' Party head Eva Glavischnig declared, "It is all the greater perfidy that there will be dancing today on the graves of Auschwitz."

Organizers point out that the ball traditionally takes place on the last Friday in January, but federal government minister Gabrielle Heinisch-Hosek scoffed at their insistence that the timing this year with international Auschwitz commemorations was coincidence.

She called the timing "a big provocation" in comments to The Associated Press, while Greens' Party member Niki Kunrath said the fact "that right-wing extremists can still assemble in the most magnificent halls of the country" was a national shame.

Formally, Austria has moved from a postwar portrayal of being Nazi Germany's first victim to acknowledging that it was Hitler's willing partner. Most young Austrians reject Nazi ideology and condemn the part their parents might have played in the Holocaust.

At the same time, the rightist-populist Freedom Party ? whose supporters range from those disillusioned with the more traditional parties to Islamophobes and Holocaust deniers ? has become Austria's second-strongest political force.

The party, a strong defender of the ball, confirmed Friday that Marine Le Pen, head of France's National Front, planned to attend the event, along with Belgium's Philip Claeys of the Vlaams Belang party and other European far rightists.

The Freedom Party itself went on the offensive, saying the real threat to society came from leftists planning to demonstrate against the ball and warning Austrian Jewish leader Ariel Muzicant that it might press charges of incitement against him for encouraging the protests.

The ball is staged mostly by dueling fraternities including far-right members who display saber scars on their cheeks as badges of honor. But Freedom Party leader Heinz-Christian Strache described the event as "an academic ball, not a political ball."

He accused "extreme-left" opponents of trying to sabotage his party and warned that the protests being organized outside the venue were being organized by anarchists backing "the rule of the street."

But demonstrations that began as the ball guests started to converge on the Hofburg were generally peaceful, with most of the approximately 2,500 demonstrators respecting police lines separating them from the venue.

In the only reported incident, some of the guests were delayed when the two buses carrying them were briefly blocked by sitting protesters who were quickly removed by police.

Although the ball regularly comes under criticism, its overlap this year with the Auschwitz liberation anniversary has increased pressure on organizers and attendees

Because it was listed among other annual champagne-laced Viennese balls, an Austrian committee reporting to UNESCO, the U.N.'s culture organization, struck all the balls from its list of Austria's noteworthy traditions last week.

While some of the more opulent Vienna balls are criticized as a showcase of the rich, most are devoid of direct political controversy. For centuries, the city's high society has waltzed blissfully through wars, recessions and occasional firebomb-throwing anarchists opposed to the moneyed decadence they think such events represent.

But the WKR ball started drawing flack as Austrians began to come to grips decades ago with the fact that their country was one of Nazi Germany's most willing allies instead of its first victim through its 1938 annexation by Hitler.

Bowing to the pressure, the Hofburg palace announced late last year that the ball will have to move elsewhere as of 2013.

NC gov's re-election decision could benefit Obama (AP)

RALEIGH, N.C. ? The key battleground state of North Carolina is still within President Barack Obama's grasp, despite Democratic Gov. Beverly Perdue's surprise decision to drop her re-election campaign.

Obama has been running commercials in the state for months, and the Democrats have staked so much on repeating his 2008 success in North Carolina that their presidential nomination convention will be held in Charlotte.

"It's helpful news for Obama rather than problematic news," John Dinan, a political science professor at Wake Forest University, said of Perdue's announcement Thursday. "You'd expect the Obama campaign would rather run with a strong gubernatorial candidate on the ballot, and by all accounts, Perdue was not a strong candidate."

Perdue, the first woman elected governor in North Carolina history, said she worried a fight with Republicans over public education would become too political if she tried for a second term. But Perdue entered the election year with political baggage, including a campaign finance investigation, sagging poll numbers and a tough rematch campaign against an opponent she narrowly beat in 2008, when Obama's coattails helped Democrats across the state.

"North Carolina's a swing state, they can't afford to lose it for the presidential race," said Michael Munger, a political science professor at Duke University who ran for governor as a Libertarian in 2008. "I would guess some senior Democratic people strongly suggested she spend more time with her grandchildren."

Four years ago, Obama shocked many national pundits by becoming the first Democratic presidential nominee to carry the state since Jimmy Carter in 1976, defeating Republican Sen. John McCain by just 14,177 votes out of more than 4.3 million ballots cast.

Perdue, then the state's lieutenant governor, benefited from Obama's highly organized effort to boost voter turnout, an effort the president will look to repeat regardless of whether the Democratic gubernatorial nominee is an incumbent.

"I don't think the president's 2012 chances are affected by this in any way," said Andy Taylor, a political science professor at North Carolina State University. "The presidential race is the dog and the gubernatorial race is the tail, and the dog is going to be wagging the tail."

Obama's win here was the first in 32 years for a Democratic nominee for president. He praised Perdue for breaking down barriers during her political career.

"For over 25 years, she has fought for the people of the Tar Heel state ? working to transform the state's public schools, improve the health care system, protect and attract jobs for members of the military and their families, and create the jobs of the future," Obama said in a statement.

Perdue, a former school teacher, said her decision was about protecting public education from spending cuts by the GOP-led legislature.

"The thing I care about most right now is making sure that our schools and schoolchildren do not continue to be the victims of shortsighted legislative actions and severe budget cuts inflicted by a legislative majority with the wrong priorities," Perdue said in a statement.

The statement made no mention of what Perdue, 65, planned to do in the future. Perdue campaign spokesman Marc Farinella said the governor declined to speak to reporters Thursday because she was spending time with her family after making "this very difficult decision."

"For now she wants her statement to speak for itself," he said.

Perdue's decision means it will be the first time a sitting North Carolina governor has failed to get elected to a second term since voters gave chief executives authority to succeed themselves in the 1970s.

"All the Democrats' waters rose with Obama in 2008," said Brian Nick, a Republican strategist working for likely GOP gubernatorial nominee Pat McCrory. "It would be a fallacy to think the governor's race is going to affect the presidential campaign in North Carolina."

Perdue has faced high unemployment, consistently weak approval numbers, a string of political defeats and the indictment of two close aides and a family friend in a campaign finance scandal that is continuing to unfold. She has also made some well-publicized gaffes, like a joking suggestion last year that congressional elections should be suspended for two years to ease partisan gridlock.

North Carolina is crucial to Obama's re-election strategy, with a win there relieving the need to carry more-traditional battleground states such as Florida and Ohio.

Perdue is listed as the co-chair of steering and host committee membership for the 2012 convention. DNC officials were quick to say Thursday that Perdue's withdrawal from the governor's race will have no effect on the September event.

The governor has not been closely involved in the convention planning and was not present at a DNC media conference in Charlotte last week announcing that President Obama would give his acceptance speech to Bank of America Stadium.

"They made the decision to site the convention in Charlotte knowing that Beverly Perdue was facing an uphill fight," said Steven Greene, a political science professor at N.C. State. "That was already factored into their decision."

Perdue may try to maintain a low profile through the end of her term early next year. After issuing a statement declaring her intention not to run, Perdue holed up in the governor's mansion with her aides.

Mark Johnson, the governor's deputy communications director, said the governor has no public events scheduled for the next week.

"Anything beyond next week is tentative," Johnson said.

Analysis: Wall Street puzzles over Google's new direction (Reuters)

SAN FRANCISCO (Reuters) ? Google Inc, which revolutionized Internet searches with an easy-to-use website, has itself become an increasingly tricky business to grasp.

That issue leapt to the fore last week when the company stunned Wall Street by missing financial expectations for the fourth quarter -- sending its stock into a tailspin and triggering a flurry of questions over what went askew.

Analysts say Google is simply putting its fingers in too many pies. Forays into television, Android mobile phones and music sales in the past two to three years have left the investment community straining to recognize the company.

A surprise drop in Google's search advertising rates in the fourth quarter raised questions about how its rapidly expanding mobile business was affecting its main money-making machine.

With investors still uneasy about Google's proposed $12.5 billion acquisition of smartphone maker Motorola, the earnings disappointment underscored a big challenge facing Chief Executive Larry Page as he positions the company for new growth opportunities.

Some are wondering if Google has a clear strategy for generating revenue and growth out of a plethora of fledgling initiatives, from Android to its Facebook wannabe, Google+, especially since Page and management refuse to offer guidance.

"Right now people are skeptical about those bets paying off," said Walter Price, a portfolio manager at RCM Capital Management, referring to Google's efforts outside its flagship search business.

Google's managers "get on a conference call and they're super enthusiastic about their future, and yet you look at the (stock's) multiple and the way the stock is treated, and people don't share that enthusiasm," said Price, whose firm owns Google shares.

Google's stock closed at $569.49 on Wednesday, down from a four-year high of $670.25 earlier this month. The stock trades at 13.6 times forward earnings, compared to the 12.3 average multiple for companies on the S&P 500.

The limited insight Google provides on the details of its non-search businesses has not helped matters, as investors struggle to connect the company's ambitious strategic vision with its income statement.

In that sense, Google is very like Amazon.com Inc, which warned in October it could lose money in the fourth quarter as the online retailer spends heavily on the Kindle Fire tablet and other projects. Amazon is due to report results on January 31.

"Google is very much in the midst of a transformation," said BGC Partners analyst Colin Gillis.

Page has "taken some aggressive big bets here, stuff that's going to be hard to undo," said Gillis, citing the Motorola deal, which he estimated will lop 600 basis points off of Google's profit margin when the acquisition is completed.

THICKER ARROWS

If Page's bets pay off, search could represent just one of several large and thriving businesses as Google recasts itself as a full-fledged "media and services" company.

Since replacing Eric Schmidt last April as CEO, the Google co-founder has aggressively tossed out underperforming and non-essential projects and products. The idea is to put "more wood" behind the company's most important arrows, he has said.

Among those arrows are Google+, the eight-month old social network; Android, the smartphone operating system; and YouTube, the video Website it bought six years ago for $1.65 billion.

Clearly, these have been very successful ventures. Android has become the world's No. 1 smarpthone operating system, surging past Apple Inc's iOS, the software that powers the popular iPhone. YouTube is delivering 4 billion video views per day. And 90 million users have signed up for Google+.

What is less clear is how much money Google can eventually generate from these largely free services, such as from advertising sales.

For Google to keep growing, it needs access to a wider range of content on which it can place ads and make money, particularly as the tech landscape shifts and consumers' Internet habits evolve.

"Any walled-off content is the enemy of Google, so they're trying to pry it open. They did it well with Android, they're trying it with social media and they're trying it with television," said MIT Sloan School of Management Professor Michael Cusumano.

The strategy is not cheap, requiring significant investments for Google to build or buy platforms to reach new content -- adding pressure on the bottom line. And many of the new markets may not be as profitable as the search ad business where Google rules the roost, said Cusumano.

Google does not disclose how much money it has spent on Google+. But analysts believe much of Google's aggressive hiring during the past year -- its headcount swelled to more than 8,000 employees in 2011 alone -- was to feed its social efforts as it seeks to challenge Facebook's 800 million user network.

Microsoft's ongoing efforts to displace Google in search provide a stark reminder of the steep price involved in going head-to-head with an entrenched Web company: in the last eight quarters, Microsoft's online services unit has lost roughly $4.9 billion.

Google+, which does not currently feature ads, is still in its infancy and the company has yet to outline its monetization plans for the service. But Macquarie Research analyst Ben Schachter said the benefits of some of Google's other non-search initiatives, such as the vast amount of online video it now streams across the Web on YouTube, are coming into focus.

"The goal at the end of the rainbow is TV advertising," he said. "For years Google has been eating the lunch of print and radio, but TV has held up incredibly well."

That will start to change by the second half of this year and into 2013, when Schachter expects that TV advertising dollars will flow to online video providers like Google.

TIME FOR A REPORT CARD?

In October, Google said that its mobile business was generating revenue at a $2.5 billion annualized run rate, up from $1 billion a year earlier.

But while the figures provide evidence that Google's mobile efforts are bearing fruit, they leave plenty of questions unanswered, including what portion of the revenue is mobile search ads versus mobile display ads, and how much money is generated from users of Android devices versus Apple iPhones on which Google presumably has to share some of the revenue.

Google's $5 billion run rate for its graphical display ads is similarly murky. And Google's updates on the business are unpredictable: The company has only provided a display ad run-rate figure two times, with five quarters elapsing between the updates.

With mobile and display representing greater portions of Google's business, some say the time has come for the company to be more forthcoming to push its price/earnings multiple higher.

"If they want multiple expansion they need to provide more clarity," said National Alliance Capital Markets analyst Mike Hickey. "If someone asks them how's an aspect of the business 'terrific' just doesn't cut it anymore."

It is, however, unlikely that Google will go so far as to provide financial forecasts -- a practice the company has shunned since its earliest days.

But more consistent and detailed reporting of some of its key businesses could bolster Wall Street's faith in the company's prospects outside search, and quell some of the persistent anxiety about its spending.

"We need a report card," said RCM Capital Management's Price, noting that he believes Google's current search business is only the "tip of the iceberg" when it comes to the company's longer term money-making prospects.

Asia stocks rise as Apple result lifts tech shares (AP)

BANGKOK ? Asian stocks rose Wednesday as investors stayed calm in the face of a possible debt default by Greece to search for good deals in technology shares boosted by stunning results from Apple Inc.

Japan's Nikkei 225 index rose 1 percent to 8,870.22. South Korea's Kospi gained 0.8 percent at 1,964.72 and Australia's S&P ASX 200 added 1 percent to 4,268.70. Benchmarks in Singapore and New Zealand rose, while shares in the Philippines fell.

Markets in Hong Kong, mainland China and Taiwan remained closed for Chinese New Year.

Japan's powerhouse export sector got a lift from a moderation in the yen's strength even as the country reported its first annual trade deficit since 1980. A strong yen, which hit multiple historic highs last year against the dollar, shrinks the value of overseas earnings when repatriated and makes Japanese products less competitive.

Honda Motor Corp. rose 3.3 percent. Mitsubishi Motor Corp. jumped 4.4 percent and Sony Corp. added 3.1 percent. Tire-maker Bridgestone Corp. added 3.4 percent.

Technology stocks were elevated after Apple Inc. reported earnings that sailed past analyst estimates. Apple said late Tuesday said it sold 37 million iPhones in the last three months of 2011, vastly exceeding estimates and propelling the company to record quarterly results.

That stellar performance reverberated throughout the global tech industry. South Korea's LG Electronics Inc., which ranks No. 2 globally in flat screen televisions, jumped 4.1 percent. Hynix Semiconductor Inc., the world's second-largest memory chip maker, added 2.2 percent.

Stan Shamu of IG Markets in Melbourne said in an email that the gains in Asia suggested "investors are now starting to pay less attention" to Greece, which is struggling to reach a deal with creditors to prevent a chaotic default on its massive debts. A default could trigger a financial crisis in Europe and likely beyond.

Greece is trying to get its creditors to swap Greek government bonds for new ones that have half the face value. Greece faces an important bond repayment deadline in March.

The Dow Jones industrial average closed down 33 points at 12,676 on Tuesday. The Standard & Poor's 500 lost a point to close at 1,315. The Nasdaq added two points to close at 2,787.

Benchmark oil for March delivery rose 35 cents to $99.26 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell 63 cents to end at $98.95 per barrel on the Nymex on Tuesday.

In currency trading, the euro rose to $1.3026 from $1.3021 late Tuesday in New York. The dollar rose to 77.91 yen from 77.73 yen.

PARK CITY, Utah ? Comedian and "30 Rock" cast member Tracy Morgan has been released from a hospital after collapsing during the Sundance Film Festival, and he says he'll be back at work Tuesday.

Morgan's publicist, Lewis Kay, confirmed Monday that the actor left the Park City Medical Center after he suffered from exhaustion and altitude Sunday night in Park City, where the elevation is 7,000 feet.

Morgan posted a comment Monday on Twitter that the high altitude "shook up this kid from Brooklyn."

"Superman ran into a little kryptonite," he quipped.

He also said on Twitter that he would be back to work Tuesday on "30 Rock."

Ron Nyswaner, co-director of the Sundance film "Predisposed," in which the actor stars, said Morgan's collapse resulted from "altitude sickness combined with his diabetes. And he hadn't eaten. He hadn't had enough water."

Kay said hospital officials report no drugs or alcohol were found in Morgan's system.

Morgan had been attending an event for the Creative Coalition at which he had just received an award.

In "Predisposed," which stars Jesse Eisenberg and Melissa Leo, Morgan plays a drug dealer caught up in the push-and-pull between a piano prodigy and his troubled mother.

Gingrich wins South Carolina GOP primary

Newt Gingrich has won the South Carolina Republican primary, capping off a remarkable comeback for his presidential bid that reshapes the trajectory of the battle for the GOP nomination as the race now heads to Florida and beyond.

The results mark the end of a tumultuous week in politics that saw Gingrich erase and then overcome the lead former Massachusetts Governor Mitt Romney had in the Palmetto State following his victory in the Jan. 10 New Hampshire primary. Gingrich came on strong in the closing days of the campaign, looking to rally under his banner the many conservatives unwilling to get behind Romney, who had sought to posture himself as the eventual nominee.

"We don't have the kind of money at least one of the candidates has," Gingrich said in his victory remarks.?"But we do have ideas and we do have people. And we proved here in South Carolina that people power with the right ideas beats big money."

Gingrich spent most of his speech Saturday night?lashing out at "media elites" in New York and Washington, D.C., while castigating President Obama. He leaned on wonky explanations of policy to draw contrasts with the president, whom Gingrich accused of representing values antithetical to "classical" America.

"It's not that I am a good debater. It's that I articulate the deepest-felt values of the American people," said Gingrich, who admitted at a Thursday debate to sometimes thinking in grandiose terms.

Amidst cheers of "Newt can win," Newt Gingrich calls the S.C. race "humbling" and "sobering" to see so many supporters rally behind his political message.

The evening's second-place finisher, Romney, drew on elements of his stump speech, but also started to preview rhetoric that will become part of his pitched case versus Gingrich in Florida's?primary on Jan. 31.

"We're now three contests into a long primary season ... We've still got a long way to go, and a lot of work to do," Romney said in his?remarks Saturday night.

Gingrich, Romney said, had joined Obama in launching a "frontal assault on free enterprise," referencing the ex-speaker's attack on Romney's record at Bain Capital.

"Those who pick up the weapons of the left today will find them turned against us tomorrow," Romney said. "If Republican leaders want to join this president in demonizing success...then they're not going to be fit to be our nominee."

After finishing second in the South Carolina primary, Mitt Romney says the race is "getting even more interesting," and tells the crowd, "there is so much worth fighting."

The results in South Carolina only raise the stakes for the battle in Florida, a traditionally expensive contest where voting is closed to only registered Republicans, and the winner is awarded all of the delegates.

The Romney campaign is hoping that contest will be its firewall. They appeared poised to make their argument versus Gingrich even more sharply in the state. They circulated a ?flashback? video on Saturday reminding voters of the ethics investigation Gingrich had faced during his speakership.

The former speaker made reference to the next primary several times in his victory speech Satuday.

"With your help, we are now moving onto Florida and beyond," he said, later asking for supporters' help in reaching out to Floridians.

Gingrich, who will appear on NBC's "Meet the Press" on Sunday morning,?hopes to capitalize there?on his finish in South Carolina, which was driven in part by late deciders, who broke decisively in his direction in the last few days of the campaign. That stretch saw two debate performances by Gingrich, on Monday and Thursday nights. Almost two-thirds of voters said the debates were an important factor in their decision, and Gingrich won about half of them.

More broadly, core elements of the GOP base in South Carolina ? conservatives, Tea Party supporters and evangelical Christians ? broke for Gingrich. And the former speaker even edged Romney in two important constituencies for the former Massachusetts governor: voters who said electability in November was their most important concern in a nominee, and voters who said the economy was their top issue.

The South Carolina results underscore Romney?s lingering inability to overcome skepticism from conservatives about electing him as their standard-bearer against Obama this fall.

Gingrich had erased Romney?s lead by abandoning his previous pledge to wage a ?relentlessly positive? campaign. The former speaker eventually embraced a strategy of drawing strong contrasts with Romney and benefited from the negative advertising run on his behalf by a super PAC ? a practice Gingrich loudly denounced in Iowa, where he saw his poll numbers collapse amid attacks by a pro-Romney super PAC.

His victory provides, if nothing else, a symbolic imprimatur; the winner of the South Carolina primary has gone on to win the nomination in each Republican primary since the contest?s inception in 1980.

The South Carolina results capped one of the most?unpredictable weeks in the presidential campaign thus far, a week that saw two candidates leave the race and the veneer of inevitability the Romney campaign had built for itself erode by the end.

Recertified results in the Iowa caucuses found that he had actually lost the contest by a handful of votes to former Pennsylvania Sen. Rick Santorum. And Romney has fought to withstand some of the most intense scrutiny he?s faced during the campaign; critics have assailed his private equity career and demanded Romney release his tax returns ? demands which only reached a fever pitch after Romney estimated he pays an effective rate of 15 percent of his income in taxes.

Moreover, Romney?s performance in South Carolina will speak volumes about his fractious relationship with movement conservatives. He?s struggled at times to break through a ceiling on his support from those voters, who are skeptical of Romney?s past conversion on abortion rights and his embrace of authorship of a health care law as governor that closely resembles Obama?s 2010 reform law.

Nonetheless, the fact that Gingrich has arrived at the precipice of political resurrection ? again ? this cycle is itself remarkable.

Political observers had questioned when, not if, he would drop out after suffering missteps at the outset of his campaign that led to the defection of virtually all of his top staff last June. But Gingrich stuck with it and climbed to the top of the polls in Iowa, only to see his numbers implode again after weathering attacks from super PACs and Texas Rep. Ron Paul?s campaign.

In South Carolina, the former speaker has been aided by a variety of factors contributing to his potential comeback. He?s scored major points with voters with a couple of strong debate performances this week, particularly by way of launching acerbic attacks on the media. His angry refusal to answer allegations made by an ex-wife topped headlines coming out of a debate on Thursday ? the same day that saw Texas Gov. Rick Perry drop his own campaign and endorse Gingrich.

The winnowed field (Jon Huntsman also ended his campaign and endorsed Romney), only reduced the number of candidates threatening to divide the anti-Romney vote in South Carolina.

Santorum, crowned the winner of the Iowa caucuses upon further review of the vote totals, had doggedly criticized both Romney and Gingrich in hopes of rallying conservatives behind his unflashy, if consistent, record.

"Three states, three winners -- what a great country," he said in remarks Saturday evening, vowing to continue his campaign through Florida and subsequent nominating contests.

Keep in mind, we are only looking at debt options so think of loans and lines of credit that you pay back to a lender.? We are not looking at any equity solutions such as angel investors, venture capital, etc.? The good news is that there are options.? The bad news is that nothing is easy nowadays and if you have damaged credit or you?re looking for several hundred thousand dollars it?s much less likely to happen purely with debt.

I have split these 8 solutions into two parts based on the likelihood and value factors.? Simply put, likelihood just asks the question, ?How likely is it that this type of financing can be obtained by a higher percentage of people??? Value is all about how much value would each form of financing bring to business owners who utilized this form of financing.? So let?s get started.

Here are the 4 most likely forms of debt financing for small business startups:

Credit Cards
This is absolutely, positively, without doubt the most common form of financing for small business startups.? Additionally, credit card financing ? when it is done right ? is arguably the least expensive form of financing.? From a benefit perspective they also do not require collateral like many other forms of financing.? The problem is that when credit card financing is not done correctly ? and normally it is not ? you will hurt your credit profile, pay too much in interest, you will not properly separate your personal & business credit, and you?ll likely miss out on some good tax benefits.

ROB?s
Technically known as Rollovers as Business Startups ? are only an option for people who have saved up some adequate retirement funds.? It?s also much more risky than most other forms of financing.? This is a very popular form of financing for new franchisees.? The downside is you?re risking your future basically since you?re tapping your retirement savings.? The upside is that you can access a sizeable amount of capital if you have a nice nest egg waiting for you.

Trade Credit
Maybe it?s not as popular but it is very common.? Examples of trade credit ? which is also referred to as vendor credit ? would be a line of credit at Staples, or Dell, or any other company where you need to purchase their goods or services for your business.? There are many forms of trade credit where you can obtain loans and lines of credit that are revolving in nature?meaning the balances are not due in full and can be spread out over several months or several years.? However, the most common ?terms? attached to trade credit are Net 30.? So there is not the same value or ability to finance nearly as much since you?re only delaying the purchase by a month or maybe two.

Equipment Financing
Most startup companies need some type of equipment.? Ideally, if the goal is to use your capital in the best way possible, you wouldn?t use a working capital loan or line of credit to purchase equipment.? Sometimes it is necessary but, often times, you can get a loan or lease specifically for your equipment and then leave your cash, working capital loans, and credit cards available for other uses.

Top Iraqi Shiite cleric urges end to crisis (AP)

BAGHDAD ? An aide to Iraq's most prominent Shiite cleric is urging politicians on both sides of the country's sectarian divide to end a government crisis, as fears of civil war rise a month after the U.S. military withdrawal.

Grand Ayatollah Ali al-Sistani's aide Ahmed al-Safi said during a Friday sermon in the holy city of Karbala that the war-ravaged country "cannot bear further tensions among politicians."

Sistani, revered among Iraqi Shiites, normally exerts his influence through sermons and statements made by his aides.

The crisis erupted last month after the Shiite-led government issued an arrest warrant against the Sunni vice president on terrorism charges. In protest, the Sunni-backed bloc has been boycotting parliament and Cabinet sessions.

Beijing releases key air pollution data

(AP) ? Caving to public pressure, Beijing environmental authorities started releasing more detailed air quality data Saturday that may better reflect how bad the Chinese capital's air pollution is.

The initial measurements were low on a day where you could see blue sky. After a week of smothering smog, the skies over the city were being cleared by a north wind.

The readings of PM2.5 ? particulate matter less than 2.5 micrometers in size or about 1/30th the average width of a human hair ? were being posted on Beijing's environmental monitoring center's website. Such small particulates can penetrate deep into the lungs, so measuring them is considered a more accurate reflection of air quality than other methods.

It is the first time Beijing has publicly revealed PM2.5 data and follows a clamor of calls by citizens on social networking sites tired of breathing in gray and yellow air. The U.S. Embassy measures PM2.5 from a device on its rooftop and releases the results, and some residents have even tested the air around their neighborhoods and posted the results online.

Beijing is releasing hourly readings of PM2.5 that are taken from one monitoring site about 4 miles (7 kilometers) west of Tiananmen Square, the monitoring center's website said Saturday. It said the data was for research purposes and the public should only use it as a reference.

The reading at noon Saturday was 0.015 mg/m3, which would be classed as "good" for a 24-hour exposure at that level, according to U.S. Environmental Protection Agency standards. The U.S. Embassy reading taken from its site on the eastern edge of downtown Beijing said its noon reading was "moderate." Its readings are posted on Twitter.

Steven Andrews, an environmental consultant who has studied Beijing's pollution data since 2006, said he was "already a bit suspicious" of Beijing's PM2.5 data. Within the 24-hour period to noon Saturday, Beijing reported seven hourly figures "at the very low level" of 0.003 milligrams per cubic meter.

"In all of 2010 and 2011, the U.S. Embassy reported values at or below that level only 18 times out of over 15,000 hourly values or about 0.1 percent of the time," said Andrews. "PM2.5 concentrations vary by area so a direct comparison between sites isn't possible, but the numbers being reported during some hours seem surpisingly low."

The Beijing center had promised to release PM2.5 data by the start of the Chinese Lunar New Year on Monday. It has six sites that can test for PM2.5 and 27 that can test for the larger, coarser PM10 particles that are considered less hazardous. The center is expected to buy equipment and build more monitoring sites to enable PM2.5 testing.

Beijing wasn't expected to include PM2.5 in its daily roundups of the air quality anytime soon. Those disclosures, for example "light" or "serious," are based on the amount of PM10, sulfur dioxide and nitrogen dioxide in the air.

Beijing interprets air quality using less stringent standards than the U.S. Embassy, so often when the government says pollution is "light," the embassy terms it "hazardous."

"There has been tremendous amounts of attention in the Chinese media ? whichever newspaper you pick up, whichever radio station you listen to, channel you watch ? they are all talking about PM2.5 and how levels are so high," said Andrews.

"What has been so powerful is that people are skeptical, and I think rightly skeptical," about the government's descriptions of data, he said.

Demjanjuk seeks funds to sue German paper (AP)

BERLIN ? John Demjanjuk, who was convicted last year of serving as a Nazi death camp guard, is asking for German state financial help to sue the country's biggest-selling newspaper for alleged defamation, a court said Thursday.

Duesseldorf state court spokesman Ulrich Egger told The Associated Press that Demjanjuk is complaining Bild newspaper's website labeled him a "war criminal" and a "Nazi henchman" before he was convicted last May of 28,060 counts of accessory to murder.

A lower court granted Demjanjuk financial help to sue, but for a maximum of euro5,000 ($6,400) in damages, ruling more could not reasonably be expected.

The 91-year-old is now appealing that decision, saying that he needs funding to sue for euro25,000. Egger says it is unclear when a ruling will be issued.

Bild maintains that its reporting didn't go beyond the permitted limits, according to the court.

Demjanjuk's family says the retired Ohio autoworker he has no financial resources. He cannot leave Germany because he has no passport after being stripped of his U.S. citizenship ahead of his deportation in 2009.

At his trial in Munich, judges found that evidence showed Demjanjuk was a guard during the war at the Nazis' Sobibor death camp in occupied Poland. They sentenced him to five years in prison.

Demjanjuk was released pending an appeal. It isn't clear when a federal court might rule on that.

The case was the first time someone was convicted in Germany on the basis only of having been a guard, without evidence of a specific killing.

Ukrainian-born Demjanjuk was a Soviet Red Army soldier captured by the Germans in Crimea in 1942.

The Munich court found that he had agreed to serve the Nazis as a guard at Sobibor. Demjanjuk has consistently rejected the allegation, insisting he never served as a guard anywhere and was held in German camps himself for much of World War II.

True to their name, boa constrictors squeeze the life out of their prey. But how does a boa know it's snuffed out a rat? The snake listens for a heartbeat. When it stops, that's the cue to let go, according to a study in the journal Biology Letters. [Scott M. Boback et al, Snake modulates constriction in response to prey?s heartbeat]

Researchers outfitted rat cadavers with artificial beating hearts. They used dead rats to control for other signs of passing, like muscle spasms. Then they warmed up the rats, set the hearts pumping, and dangled them in front of hungry boas.

The snakes attacked. And as long as that rat heart kept thumping, the boas kept tightening their coils and applying bursts of pressure, sometimes for more than 20 minutes. But as soon as scientists killed the heartbeat, the boas loosened up.

Even captive-born boas who'd never hunted live prey paid attention to the pulse?suggesting the behavior is innate. And for good reason. The authors say constriction takes a lot of energy. And it can be dangerous, say, if an enemy strikes while the snake's coiled around its quarry. But by following the telltale heart, boas can keep the pressure on just long enough. Larkin elected to baseball Hall of Fame

NEW YORK (AP) -- Barry Larkin has been elected to baseball's Hall of Fame.

The shortstop received 86 percent of the vote in balloting announced Monday by the Baseball Writers' Association of America, well above the necessary 75 percent. Larkin was on the ballot for the third time after falling 75 votes short last year.

He will be inducted on July 22 at Cooperstown along with the late Ron Santo, elected last month by the Veterans Committee.

Next year's ballot figures to be the most controversial, with Barry Bonds, Roger Clemens, Sammy Sosa, Mike Piazza, Craig Biggio and Curt Schilling eligible for the first time.
